No. Watching legal porn isn’t a crime for adults in Texas. The state’s 2023 law, HB 1181, targets websites instead: sites where more than one-third of the content is “sexual material harmful to minors” must check that visitors are 18 or older or face fines of up to $10,000 a day (Texas Legislature).
The US Supreme Court upheld the law 6–3 on June 27, 2025, and 27 states now have similar laws.
In this article, we’ll break down what’s legal and illegal in Texas, what HB 1181 requires, the full court timeline, how Texas enforces the law, VPN data, other Texas porn laws and public opinion.
This article is general legal information, not legal advice.
Top Statistics on Texas Porn Law
- HB 1181 covers websites where more than one-third of the content is sexual material harmful to minors, not the adults who watch it.
- Sites without age checks face fines of up to $10,000 a day, plus up to $250,000 if a minor gets access.
- HB 1181 passed the Texas House 141–0 and the Senate 31–0 in May 2023.
- The Supreme Court upheld HB 1181 6–3 on June 27, 2025, 665 days after the law’s start date.

- 9 of the 27 state age verification laws took effect after the Supreme Court ruling.
Is It Illegal to Watch Porn in Texas?
No. Adults can legally watch, buy and own legal porn in Texas. HB 1181’s penalties apply to “commercial entities” that run websites, and the law contains no criminal penalties at all (Texas Legislature).
The Supreme Court said it plainly in June 2025: “Adults have the right to access speech that is obscene only to minors” (Supreme Court).

What Texas does criminalize is narrower: obscene material, material involving minors, and intimate images shared without consent. “Obscene” is a legal term for material that meets all three parts of the Supreme Court’s Miller test, which most mainstream porn doesn’t.
Here’s a breakdown of what’s legal and illegal in Texas:
| Activity | Status in Texas | Law | Maximum Penalty |
|---|---|---|---|
| Watching or owning legal adult porn | Legal for adults | First Amendment | None |
| Running a porn site without age checks | Civil violation | HB 1181 (CPRC ch. 129B) | $10,000 per day, plus $250,000 if a minor gets access |
| Displaying obscene material where it may offend others | Class C misdemeanor | Penal Code §43.22 | $500 fine |
| Promoting obscene material | Class A misdemeanor | Penal Code §43.23 | 1 year in jail and $4,000 |
| Wholesale promotion of obscene material | State jail felony | Penal Code §43.23 | 2 years and $10,000 |
| Giving harmful material to a minor | Class A misdemeanor | Penal Code §43.24 | 1 year in jail and $4,000 |
| Sharing intimate images without consent | State jail felony | Penal Code §21.16 | 2 years and $10,000 |
| Producing or sharing a sexual deepfake without consent | Class A misdemeanor (felony if repeat or a minor is depicted) | Penal Code §21.165 | 1 year in jail and $4,000 (first offense) |
| Obscene material depicting a child | Second-degree felony | Penal Code §43.23(h) | 20 years and $10,000 |
Federal law adds its own obscenity and child-protection crimes. Our guide to whether porn is illegal in the US covers those penalties and the rules in other countries.
What Does the Texas Age Verification Law (HB 1181) Require?
HB 1181 requires any commercial website where more than one-third of the material is “sexual material harmful to minors” to verify that each visitor is at least 18, using digital ID, a government-issued ID or a method based on transactional data (Texas Legislature).
It sailed through the Legislature. The bill passed the House 141–0 on May 9, 2023 and the Senate 31–0 on May 19, and Gov. Greg Abbott signed it on June 12, 2023, according to LegiScan. The House later approved the Senate’s changes 133–1.

Here’s a breakdown of what HB 1181 requires:
| Rule | Detail |
|---|---|
| Who must comply | Commercial websites, including social media platforms, where more than one-third of content is sexual material harmful to minors |
| Age threshold | 18 |
| Accepted methods | Digital ID, government-issued ID or transactional data |
| Fine for no age checks | Up to $10,000 per day |
| Extra fine if a minor gets access | Up to $250,000 |
| Keeping users’ identifying information | Up to $10,000 per instance |
| Who enforces | Texas attorney general, through civil lawsuits |
| Health warnings | 3 required warnings plus a helpline notice, in 14-point font; injunction against them upheld by the Fifth Circuit on March 7, 2024 |
| Criminal penalties | None |
| In effect since | September 1, 2023 |
To put the daily fine in perspective, a full year of it adds up to $3.65 million (our calculation).
Can a site track who watches? The law forbids sites and verification services from keeping users’ identifying information after a check, with fines of up to $10,000 per instance.
The original law also required warnings claiming porn “is potentially biologically addictive.” The Fifth Circuit kept them blocked, ruling that “Texas fails the fourth prong of Central Hudson, making the health warnings unconstitutionally compelled commercial speech” (Fifth Circuit).
HB 1181 Timeline: From Texas Law to the Supreme Court
The fight over HB 1181 took 665 days from the law’s start date to the Supreme Court’s ruling, and 746 days from Abbott’s signature (our calculation).
The Free Speech Coalition, an adult industry trade group, sued on August 4, 2023. Senior US District Judge David Alan Ezra blocked the law on August 31, 2023, a day before it was due to start, according to Tech Policy Press.

Here’s a timeline of the HB 1181 case:
| Date | Event | Result |
|---|---|---|
| June 12, 2023 | Gov. Abbott signs HB 1181 | Set to start September 1, 2023 |
| August 4, 2023 | Free Speech Coalition sues | Free Speech Coalition v. Colmenero filed |
| August 31, 2023 | Judge Ezra grants preliminary injunction | Law blocked |
| September 19, 2023 | Fifth Circuit administrative stay | Law can take effect |
| November 14, 2023 | Fifth Circuit stay pending appeal | Enforcement continues |
| March 7, 2024 | Fifth Circuit rules | Age-check injunction lifted; health-warning injunction upheld |
| March 14, 2024 | Pornhub disables access in Texas | Site unavailable |
| April 30, 2024 | Supreme Court declines to pause the law | No public dissents |
| July 2, 2024 | Supreme Court agrees to hear the case | Review granted |
| January 15, 2025 | Oral argument | – |
| June 27, 2025 | Free Speech Coalition v. Paxton decided | Upheld 6–3 |
The Fifth Circuit panel was split. Judge Jerry Smith’s majority used rational-basis review, the most lenient test, while Judge Patrick Higginbotham dissented in part (Fifth Circuit).
What Did the Supreme Court Decide?
The Court upheld HB 1181 by 6–3. Justice Clarence Thomas wrote for the majority, joined by Chief Justice Roberts and Justices Alito, Gorsuch, Kavanaugh and Barrett, while Justice Elena Kagan dissented with Justices Sotomayor and Jackson (Supreme Court).
The Court’s syllabus sums up the holding: HB 1181 “triggers, and survives, review under intermediate scrutiny because it only incidentally burdens the protected speech of adults.” That’s a middle level of review, tougher than the Fifth Circuit’s test but easier for a state to pass than strict scrutiny.
“The power to require age verification is within a State’s authority to prevent children from accessing sexually explicit content.” (Justice Thomas, majority)
“Speech that is obscene for minors is often not so for adults.” (Justice Kagan, dissent)
The majority leaned on how much the internet has changed. In 1999, 2 out of 5 American households had home internet; by 2024, 95% of American teens had access to a smartphone, and Pornhub alone published 1.36 million hours of new content in 2019, the opinion notes (FIRE).
Kagan’s 23-page dissent argued for strict scrutiny (SCOTUSblog), writing that “the State should be foreclosed from restricting adults’ access to protected speech if that is not in fact necessary” (Supreme Court).
Did Texas Ban Pornhub?
No, Pornhub left on its own. It disabled access for Texas users on March 14, 2024, a week after the Fifth Circuit ruling, rather than verify ages (KUT). Texas Attorney General Ken Paxton had already sued its owner, Aylo, in February 2024, seeking $1.6 million in fines (FOX 7 Austin).
Texas joined at least six other states where Pornhub had cut off access, according to Axios. The company behind the blocks is Aylo, and who owns Pornhub traces its fines and lawsuits.

Here’s a breakdown of Texas’s HB 1181 enforcement actions:
| Date | Company (Site) | Action | Amount |
|---|---|---|---|
| February 2024 | Aylo (Pornhub) | Attorney general lawsuit | $1.6 million sought |
| March 21, 2024 | Multi Media (Chaturbate) | Attorney general lawsuit | $1.78 million sought, plus $10,000 per day |
| March 21, 2024 | Hammy Media (xHamster) | Attorney general lawsuit | $1.67 million sought (inferred) |
| April 26, 2024 | Multi Media (Chaturbate) | Settlement; age checks through a third party | $675,000 agreed |
| July 2026 (announced) | Kick Online Entertainment (Motherless) | Court locks site’s domain after a default judgment | $9.14 million bond to unlock |
Chaturbate’s owner agreed to pay about 37.9% of what Texas first asked for (our calculation). The 2026 domain lock is a newer tactic: a Travis County judge ordered the site’s .com domain frozen until its owner posts the bond and adds age checks, according to FOX 7 Austin.
That bond equals about 2.5 years of the maximum daily fine (our calculation).
Pornhub is still pushing back. In late July 2026, it sent a letter to about two dozen Texas officials, including Abbott and Paxton, arguing that age verification laws “demonstrably do not work,” according to Axios Austin.
Do Texans Use VPNs to Get Around the Law?
Interest spiked overnight. Google searches for “Texas VPN” rose 1,750% the day after Pornhub went dark in Texas, and searches for “Is porn banned in Texas” rose 3,100%, according to a SlashGear analysis of Google Trends reported by KXAN (March 2024).

Here’s a breakdown of the measured spikes after Pornhub’s Texas block:
| Measure | Data Source | Increase | Period |
|---|---|---|---|
| Searches for “Is porn banned in Texas” | Google Trends (SlashGear) | 3,100% | Day after the block |
| Searches for “Texas VPN” | Google Trends (SlashGear) | 1,750% | Day after the block |
| Searches for “How to access Pornhub” | Google Trends (SlashGear) | 1,600% | Day after the block |
| VPN demand, peak | Top10VPN | 275% | March 14–18, 2024 |
| VPN demand | vpnMentor | 234.8% | March 15, 2024 |
| Web traffic from Texas | ExpressVPN | 48% | Week after the block |
These are short-term spikes reported mostly by VPN companies, not lasting use. For scale, the UK’s spike after its 2025 age checks was about 7.2 times the size of Texas’s on Top10VPN’s measure (our calculation).
Viewing mostly moved rather than stopped. Across states where Pornhub shut down, time on Pornhub fell 54% but time on XVideos rose 33%, and total time on the top 25 adult sites fell only about 10%, according to a 2026 study by economists Brown, Davis and Pope (NBER working paper). A separate study found Google searches for VPNs rose 23.6% three months after state laws took effect (Lang et al., 2026).
How Many States Followed Texas?
27 states, or 54% of all states, now require porn sites to verify ages, up from 6 at the end of 2023 (Age Verification Providers Association). When the Supreme Court ruled, its opinion counted Texas plus “at least 21 other States” with similar laws.
The ruling cleared the way for more. 9 of the 27 laws took effect after June 27, 2025 (our count from the Free Speech Coalition table).

Here are the laws that took effect after the Supreme Court ruling:
| State | Law | In Effect Since |
|---|---|---|
| Georgia | SB 351 | July 1, 2025 |
| South Dakota | HB 1053 | July 1, 2025 |
| Wyoming | HB 43 | July 1, 2025 |
| North Dakota | HB 1561 | August 1, 2025 |
| Arizona | HB 2112 | September 26, 2025 |
| Ohio | HB 96 | September 30, 2025 |
| Missouri | Attorney general rule, then HB 1839 | November 30, 2025 |
| West Virginia | HB 4412 | June 12, 2026 |
| Iowa | HF 864 | July 1, 2026 |
Texas is still the biggest. Its 31.7 million residents make up 18.0% of the roughly 175.9 million people living in age verification states (our calculation from U.S. Census Bureau data). Porn ban states lists every other law, its penalty and whether Pornhub blocks that state.
What Other Texas Laws Cover Porn, Obscenity and Deepfakes?
Texas criminal law targets obscene material, not legal adult porn. Promoting obscene material is a Class A misdemeanor with up to 1 year in jail and a $4,000 fine, while wholesale promotion is a state jail felony with 180 days to 2 years and a fine of up to $10,000 (Texas Penal Code §43.23).
Possessing 6 or more identical obscene items creates a legal presumption that you intend to sell or share them.

Here’s a breakdown of other Texas laws on porn, deepfakes and minors online:
| Law | Year | What It Does | Penalty or Status |
|---|---|---|---|
| Penal Code §21.16 | 2015 | Bans sharing intimate images without consent | State jail felony: 180 days to 2 years, up to $10,000 |
| Penal Code §21.165 (SB 1361) | 2023 | Bans sexual deepfake videos made without consent | Class A misdemeanor; third-degree felony if repeat or a minor is depicted (SB 441, 2025) |
| HB 449 | 2025 | Widens §21.165 to any deepfake image or media | In effect since September 1, 2025 |
| HB 581 | 2025 | Extends age checks to AI tools that make sexual images | Up to $10,000 a day, plus $250,000 if a minor gets access |
| SB 20 | 2025 | Felony to possess or promote obscene material appearing to depict a child, including AI-made | In effect since September 1, 2025 |
| HB 18 (SCOPE Act) | 2023 | Online safety rules for users under 18 | Filtering rules blocked; age registration enforceable after a 2026 Fifth Circuit ruling |
| SB 2420 (App Store Accountability Act) | 2025 | Age checks and parental consent for app downloads | Blocked December 23, 2025; enforceable since a May 28, 2026 stay, which the Supreme Court left in place July 6, 2026; argued in the Fifth Circuit August 4, 2026 |
Texas is 1 of 13 states where even a first revenge porn offense is a felony. In most other states, a first offense is a misdemeanor, as the full list of revenge porn laws by state shows.
The app store law isn’t porn-specific, but it reaches every phone. It requires parental consent before anyone under 18 downloads an app, and Judge Robert Pitman compared it to requiring “every bookstore to verify the age of every customer at the door,” as reported by The Texas Tribune.
Do Americans Support Age Verification for Porn Sites?
About 4 in 5 do in most polls. 80% of US adults said states should be able to require age verification for porn sites in an April 2025 SCOTUSPoll survey of 2,201 adults, including 88% of Republicans and 75% of Democrats, as reported by the National Catholic Register.
Wording matters, though. Support fell to 57% when YouGov asked 4,003 US adults in May 2025 a question that mentioned uploading a government ID.

Here’s how the main polls compare:
| Poll | Population | Date | Support |
|---|---|---|---|
| Cygnal (for American Principles Project) | 1,048 US likely voters | February 2026 | 81% |
| SCOTUSPoll (YouGov) | 2,201 US adults | April 2025 | 80% |
| All About Cookies (company poll) | 1,000 US adults | February 2026 | 79% |
| YouGov (ID-upload wording) | 4,003 US adults | May 2025 | 57% |
Support doesn’t mean confidence. 85% of US adults told All About Cookies that current laws are too easy to get around, and among people who found a workaround, 22% used a VPN, according to Fortune. There’s no recent public poll of Texans alone on the question.
Methodology
We reviewed 131 data points from 54 sources. The legal sections rely on the enrolled text of HB 1181 and the Senate Research Center bill analysis from the Texas Legislature, LegiScan vote records, the Supreme Court’s opinion in Free Speech Coalition v. Paxton (No. 23-1122), the Fifth Circuit’s 2024 opinion (No. 23-50627), and the Texas Penal Code.
Enforcement figures come from press reports of Texas Attorney General lawsuits; the xHamster amount is reported without the outlet tying each figure to a company. VPN and search figures come from VPN companies (Top10VPN, vpnMentor, ExpressVPN) and a SlashGear analysis of Google Trends, and measure short-term interest, not lasting use.
The Free Speech Coalition, a party to the case, is an adult industry trade group, and the Age Verification Providers Association represents verification companies. The Cygnal poll was released by a conservative advocacy group, and All About Cookies is a company poll. Day counts, the annual fine total, percentages of amounts sought, Texas’s population share and the count of laws taking effect after the ruling are our own calculations. Key Takeaways
Porn is legal for adults in Texas. HB 1181 regulates websites, not viewers: sites where more than one-third of content is harmful to minors must verify ages or face fines of up to $10,000 a day, plus $250,000 if a minor gets access, and the Supreme Court upheld the law 6–3 in June 2025.
Texas keeps widening enforcement, from a $675,000 settlement in 2024 to a $9.14 million domain bond in 2026, while 27 states now have similar laws. Searches for “Texas VPN” jumped 1,750% when Pornhub left, a reminder that age checks shift viewing as much as they stop it.
